These Terms of Service ("Terms") govern your access to and use of ultranostalgia.ca, including all pages, features, content, products, services, and functionality made available through the website (collectively, the "Site").
The Site is owned and operated by Ultra Nostalgia Ltd., an Ontario corporation ("Ultra Nostalgia", "we", "us", or "our").
The Site is hosted using Shopify's e-commerce platform and may incorporate services provided by Shopify and other third-party service providers.
By accessing or using the Site, placing an order, creating an account, or otherwise interacting with the Site, you agree to these Terms and any other policies referenced herein, including our Privacy Policy and Return Policy. If you do not agree with these Terms, please do not use the Site.
These Terms are subject to applicable Canadian and Ontario law. Nothing in these Terms is intended to exclude, restrict, or limit any right or remedy that cannot legally be excluded, restricted, or limited.
1. Eligibility
You must be at least 18 years of age, or the applicable age of majority in your jurisdiction, to enter into purchases through the Site.
By using the Site, you represent that you have the legal capacity to enter into binding agreements.
If you are using the Site on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.
2. Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms.
You must not:
- Use the Site for any unlawful, fraudulent, deceptive, or unauthorized purpose;
- Attempt to gain unauthorized access to the Site, its systems, accounts, databases, or other restricted areas;
- Interfere with or disrupt the operation, security, or integrity of the Site;
- Introduce viruses, malware, malicious code, or other harmful material;
- Use automated systems, bots, scraping tools, or other means to access or collect Site content without our prior written permission;
- Attempt to circumvent security measures, purchase limits, or other Site restrictions;
- Impersonate another person or misrepresent your identity or affiliation; or
- Use Site content or product information to operate a competing commercial service without our prior written consent.
We reserve the right to suspend or terminate access to the Site where we reasonably believe that a user has violated these Terms or engaged in fraudulent, abusive, unlawful, or disruptive conduct.
3. Electronic Communications and Contracts
When you place an order, create an account, submit a form, subscribe to communications, or otherwise communicate with Ultra Nostalgia electronically, you consent to receiving communications from us electronically, including order confirmations, invoices, shipping notifications, customer-service communications, and other transactional notices.
Electronic communications and electronic contracts may be used to form and evidence agreements between you and Ultra Nostalgia in accordance with applicable law, including Ontario's Electronic Commerce Act, 2000. Ontario law recognizes that contracts and other matters relating to their formation may be expressed electronically and that a contract is not invalid merely because it is in electronic form.
You are responsible for ensuring that the contact and email information associated with your order or account is accurate and accessible.
4. Products and Vintage Merchandise
Ultra Nostalgia specializes in vintage, collectible, retro, used, pre-owned, and previously owned merchandise.
Unless a product listing expressly states otherwise, items should be assumed to be pre-owned or vintage and may exhibit signs of age, use, storage, handling, or previous ownership.
Because many of our products are vintage or collectible, individual items may have characteristics that differ from modern manufactured goods, including:
- Cosmetic wear;
- Scratches, scuffs, dents, fading, discoloration, or surface wear;
- Aging of plastics, rubber, paper, cardboard, electronics, or other materials;
- Packaging wear or damage;
- Missing inserts, accessories, manuals, labels, or other original components;
- Writing, markings, stickers, price tags, or other previous-owner modifications where disclosed;
- Minor manufacturing variations;
- Restoration, replacement, or reproduction components where specifically disclosed; and
- Other age-related characteristics reasonably associated with vintage or pre-owned merchandise.
We make reasonable efforts to identify material defects and accurately describe the condition of each item. Product photographs form an important part of the product description, and customers should carefully review all photographs, descriptions, measurements, and condition notes before purchasing.
Where an item is described using a condition grade or terminology such as "Excellent", "Very Good", "Good", "Fair", "Near Mint", "CIB", "Complete", or similar language, that terminology reflects Ultra Nostalgia's assessment and is not necessarily an official grading designation unless expressly stated otherwise.
For graded collectibles, any grade stated by a third-party grading company refers to that company's grading determination and not a grade assigned by Ultra Nostalgia.
5. Product Descriptions and Accuracy
We make reasonable efforts to ensure that product descriptions, photographs, measurements, specifications, availability information, and other Site content are accurate.
However, minor errors, omissions, typographical errors, colour differences caused by displays or photography, and other inaccuracies may occasionally occur.
We reserve the right to correct errors or update product information at any time.
Where a material error affects an order, Ultra Nostalgia may contact the customer before fulfilling the order to confirm whether the customer wishes to proceed.
Nothing in this section limits any rights or remedies available to consumers under applicable law.
6. Product Availability
Because Ultra Nostalgia primarily sells vintage, collectible, and one-of-a-kind merchandise, inventory availability may change quickly.
A product displayed on the Site may become unavailable due to:
- A simultaneous purchase;
- Inventory or synchronization errors;
- Damage discovered before shipment;
- Loss, theft, or destruction of an item;
- An administrative or listing error; or
- Other circumstances beyond our reasonable control.
If an item becomes unavailable after an order has been placed, we will notify the customer and, where appropriate, provide a refund of amounts paid for the unavailable item.
7. Prices, Currency, Taxes, and Promotions
Unless otherwise stated, prices displayed on the Site are in Canadian dollars (CAD).
Applicable sales taxes, including Harmonized Sales Tax (HST) where required, may be added at checkout based on the customer's applicable delivery location and Canadian tax requirements.
Prices may change without notice. A price change will not affect an order that has already been accepted and confirmed, except where correction is required because of an obvious pricing or listing error or where otherwise permitted by law.
Promotional offers, discounts, coupon codes, and other promotions may be subject to additional terms and conditions. Unless expressly stated otherwise, promotions cannot be combined and have no cash value.
8. Orders and Order Acceptance
Submitting an order through the Site constitutes an offer to purchase the selected products.
An automated order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance of the order.
Ultra Nostalgia reserves the right, subject to applicable law, to refuse or cancel an order where reasonably necessary, including where:
- An item is unavailable;
- A material pricing or listing error has occurred;
- Fraudulent or unauthorized activity is suspected;
- An order appears to have been placed using compromised payment information;
- Purchase limits or promotional restrictions have been violated;
- The order cannot reasonably be fulfilled; or
- The transaction would violate applicable law or these Terms.
If we cancel an order after payment has been processed, we will refund the applicable amount paid for the cancelled item or order.
Nothing in these Terms limits statutory cancellation rights that may apply under Ontario's Consumer Protection Act, 2002 or other applicable law. Ontario law imposes specific requirements on certain internet and remote consumer agreements, including disclosure, agreement-copy, and cancellation requirements.
9. Payment
Payments are processed through payment methods made available at checkout.
By submitting payment information, you represent that you are authorized to use the payment method.
Ultra Nostalgia does not intentionally retain complete payment-card information where payment processing is handled by third-party payment processors.
Payment processing may be subject to the terms, privacy policies, and security practices of the applicable payment provider.
10. Shipping and Delivery
Ultra Nostalgia currently ships orders within Canada and the United States only. We do not currently ship to destinations outside Canada and the United States.
Available shipping options, estimated delivery times, and applicable shipping charges will be presented during checkout where available.
Delivery estimates are estimates only and are not guaranteed unless expressly stated otherwise.
Ultra Nostalgia is not responsible for delays caused by circumstances outside our reasonable control, including carrier delays, weather, labour disruptions, customs or border processing, transportation disruptions, or other events beyond our control.
Customers are responsible for providing an accurate and complete shipping address.
Where an order is returned to Ultra Nostalgia because an incorrect, incomplete, or undeliverable address was provided, additional shipping charges may apply before the order can be reshipped.
For orders shipped to the United States, the customer is responsible for any applicable customs duties, import taxes, brokerage fees, or other charges imposed by U.S. authorities or the applicable carrier, unless expressly stated otherwise at checkout.
For orders shipped within Canada, applicable taxes will be calculated and collected as required by Canadian law.
Shipping availability may vary by product, destination, carrier restrictions, or other logistical considerations. Ultra Nostalgia reserves the right to restrict shipping of particular products or to particular destinations where reasonably necessary.
11. Returns and Refunds
Returns, refunds, exchanges, and other remedies are governed by our Return Policy, as applicable to the particular purchase.
Nothing in our Return Policy or these Terms is intended to remove or restrict rights or remedies that cannot legally be excluded under applicable consumer-protection legislation.
Customers should inspect merchandise promptly after delivery and contact Ultra Nostalgia as soon as reasonably possible if an item appears to be materially different from its description, arrives damaged, or otherwise presents an issue covered by our Return Policy or applicable law.
For vintage and pre-owned merchandise, normal age-related wear and characteristics that were disclosed in the product listing are not considered defects merely because the item is not in new condition.
12. Ownership and Risk
Unless otherwise required by law, ownership of purchased merchandise transfers to the customer once Ultra Nostalgia has received payment in full and the applicable conditions of sale have been satisfied.
Risk associated with the merchandise during shipment will be handled in accordance with applicable law and the terms of the applicable carrier or shipping arrangement.
Nothing in this section is intended to restrict a consumer's statutory rights.
13. Intellectual Property
All material appearing on the Site, including but not limited to:
- The Ultra Nostalgia name;
- The Ultra Nostalgia logo and branding;
- Text and written content;
- Product descriptions;
- Photographs and images;
- Graphics;
- Designs;
- Layout and visual presentation;
- Website functionality;
- Original marketing material; and
- Other Site content
is owned by or licensed to Ultra Nostalgia Ltd. and may be protected by copyright, trademark, or other intellectual-property laws.
You may access and use Site content for personal, non-commercial purposes in connection with browsing or purchasing from the Site.
You may not reproduce, distribute, modify, republish, sell, license, publicly display, commercially exploit, or otherwise use Site content without our prior written permission, except where permitted by law.
"Ultra Nostalgia" and associated logos and branding may not be used in a manner that suggests an unauthorized affiliation, endorsement, sponsorship, or partnership.
14. User Submissions
If you voluntarily submit reviews, photographs, comments, testimonials, suggestions, or other material to Ultra Nostalgia, you represent that you have the right to submit that material and that it does not infringe another person's rights.
By submitting material to us, you grant Ultra Nostalgia a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, publish, adapt, and distribute that material for legitimate business, promotional, marketing, and Site-related purposes, subject to applicable law.
You should not submit confidential, private, or sensitive personal information through public reviews, comments, or other publicly visible areas of the Site.
We reserve the right to remove or decline to publish submissions that are unlawful, misleading, defamatory, abusive, obscene, discriminatory, fraudulent, or otherwise inappropriate.
15. Privacy
Personal information collected through the Site is handled in accordance with our Privacy Policy.
Ultra Nostalgia takes reasonable steps to protect personal information and uses personal information only for purposes permitted by applicable privacy legislation and our Privacy Policy.
As an Ontario-based private-sector business engaged in commercial activities, Ultra Nostalgia may be subject to Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), including its requirements concerning accountability, consent, appropriate collection and use, safeguards, access, and other privacy obligations.
The Site may also use third-party service providers, including Shopify, payment processors, shipping providers, analytics services, and other technology providers, which may process information on our behalf or in accordance with their own terms and privacy practices.
16. Marketing Communications
If you voluntarily subscribe to marketing communications from Ultra Nostalgia, you may receive promotional emails, product announcements, special offers, or other commercial electronic messages.
Commercial electronic messages will be sent in accordance with applicable Canadian anti-spam requirements, including Canada's Anti-Spam Legislation (CASL).
You may withdraw consent from marketing communications at any time by using the unsubscribe mechanism included in the message or by contacting us.
Transactional and service-related communications, such as order confirmations, shipping notices, invoices, account notices, and customer-service communications, may continue where permitted or required by law. CASL generally requires consent for commercial electronic messages, subject to specific statutory exceptions and forms of implied consent.
17. Third-Party Services and Links
The Site may contain links, integrations, applications, payment services, shipping services, social-media features, or other functionality provided by third parties.
These third parties operate independently from Ultra Nostalgia and may have their own terms and privacy policies.
Ultra Nostalgia is not responsible for the content, availability, security, policies, or practices of third-party websites or services to the extent permitted by law.
Your use of third-party services may be subject to the terms imposed by those third parties.
18. Site Availability and Security
We make reasonable efforts to keep the Site available and functioning properly.
However, we do not guarantee that the Site will always be:
- Available;
- Uninterrupted;
- Error-free;
- Secure from every possible threat;
- Free from viruses or other harmful components; or
- Compatible with every device, browser, operating system, or internet connection.
We may temporarily suspend, modify, restrict, or discontinue all or part of the Site for maintenance, security, operational, business, or other reasons.
19. Disclaimer
To the fullest extent permitted by applicable law, the Site and its content are provided on an "as available" basis.
Ultra Nostalgia does not warrant that the Site will operate without interruption or error or that every piece of information appearing on the Site will always be complete, current, or error-free.
For vintage and collectible merchandise, product condition, rarity, market value, historical significance, collectibility, and similar characteristics may involve subjective assessments. Unless expressly stated otherwise, such statements represent our reasonable assessment and are not guarantees of future market value or investment performance.
Nothing in these Terms excludes, restricts, or modifies any statutory warranty, condition, guarantee, right, or remedy that cannot legally be excluded, restricted, or modified.
20. Limitation of Liability
To the fullest extent permitted by applicable law, Ultra Nostalgia Ltd., its directors, officers, employees, contractors, agents, service providers, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to your use of the Site or purchase of merchandise, including loss of profits, revenue, business opportunity, data, or anticipated savings.
To the fullest extent permitted by applicable law, Ultra Nostalgia's total liability arising from a particular purchase or use of the Site will not exceed the amount actually paid by the customer to Ultra Nostalgia for the specific product or transaction giving rise to the claim.
This limitation does not apply where liability cannot legally be limited or excluded, including rights and remedies that are protected by applicable consumer-protection legislation.
21. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Ultra Nostalgia Ltd., its directors, officers, employees, agents, contractors, affiliates, and service providers from claims, losses, liabilities, damages, costs, and reasonable expenses arising from your:
- Violation of these Terms;
- Unlawful or unauthorized use of the Site;
- Fraudulent or abusive conduct;
- Violation of another person's rights; or
- Breach of applicable law.
This section does not require you to indemnify Ultra Nostalgia for losses caused by Ultra Nostalgia's own unlawful conduct or to the extent such indemnification would be prohibited by applicable law.
22. Governing Law
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Subject to any mandatory consumer-protection rights or jurisdictional rules that apply, disputes relating to these Terms or the Site will be subject to the courts of competent jurisdiction located in Toronto, Ontario.
Nothing in this section prevents a consumer from exercising a statutory right to bring a proceeding in another jurisdiction where applicable law permits or requires it.
23. Changes to These Terms
Ultra Nostalgia may update these Terms from time to time to reflect changes to our business, the Site, applicable law, or our policies.
The updated version will be posted on the Site with a revised "Last Updated" date.
Changes will apply prospectively unless otherwise required by law.
Your continued use of the Site after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.
24. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.
25. Entire Agreement
These Terms, together with the Privacy Policy, Return Policy, and any other policies expressly incorporated into these Terms, constitute the agreement between you and Ultra Nostalgia concerning your use of the Site, except where a separate written agreement applies.
If there is a conflict between these Terms and a mandatory provision of applicable law, the applicable law will prevail.
